سيادة القانون في الادارة العامة و مسألة التنمية المستدامة في الجزائر

Abstract

تهدف هذه الدارسة إلى إلقاء الضوء على مساهمة الإدارة العامة في تحقيق التنمية المستدامة في ظل سيادة القانون بالجزائر من خلال تبيان واقع إدارة التنمية المستدامة في الجزائر، بصنع وتنفيذ السياسات العامة التنمويّة، وترجع أهمية الدراسة للدور الفعال والمميز للإدارة العامة الرشيدة في تحقيق أهداف التنمية المستدامة، وبناءً على الاشكاليّة المطروحة :كيف يمكن ـأن تساهم الإدارة العامة في تحقيق التنمية المستدامة في ظل سيادة القانون بالجزائر؟ ، استناداً إلى أهم مناهج الدراسة المتمثلة في المنهج الوصفي، ودراسة حالة الجزائر، ومقاربة الاستدامة، لإيجاد بدائل تنموية جديدة خارج قطاع المحروقات في ظل مقاربة الحكم الراشد، لأنّ الجزائر تمتلك ثروة تؤهلها لتنويع اقتصادها وتحقيق التنمية المستدامة بأبعادها المختلفة، وعليه خصلت الدراسة إلى أنّه من أجل تحقيق التنمية المستدامة، يجب أن تكون هناك إدارة عامة رشيدة تكرس مبدأ سيادة القانون، للتنفيذ الفعال لسياسات التنمية المستدامة، ووجود مجتمع واع بالمسؤولية، ومن خلال تكاثف جهود جميع الفواعل الرسمية وغير الرسمية لتحقيق النمو المستدام والارتقاء بالاقتصاد الوطني، واستدامته بتشجيع الاستثمار المستدام، ودفع عجلة التنمية بما يحقق التوازن والعدالة والأمن والاستدامة.This study aims at shedding light on the general administration contribution to achieve the sustainable development in the light of law in Algeria through demonstrating the reality of the Algerian sustainable development administration in implementing the general developmental policies. The study importance refers to the rational general administration effective role in achieving the sustainable development objectives. The given problematic is as follows: how can the general administration contribute to the achievement of sustainable development in the light of law in Algeria? According to the most important study methods consisting in the descriptive method, Algeria as a case study and sustainable approach for finding new developmental alternates out of hydrocarbon sector in the light of rational administration approach, since Algeria has got a wealth enabling it to diversify its economy and achieve the sustainable development with its various dimensions. Thus, the study has concluded with the fact that the sustainable development has to be achieved in the light of rational general administration devoting the principle of law for the effective implementation of sustainable development policies. Besides, the existence of an aware society of responsibility through the cooperation between all the official and non-official doers for achieving the sustainable growth, increasing the national economy level, sustaining it through encouraging the sustainable investment and pushing forward the development wheel to the achievement of balance, justice, security and sustainability. Cette étude vise à éclairer la contribution de l'administration générale à la réalisation du développement durable à la lumière du droit en Algérie en démontrant la réalité de l'administration algérienne du développement durable dans la mise en œuvre des politiques générales de développement. L'importance de l'étude se réfère au rôle effectif de l'administration générale rationnelle dans la réalisation des objectifs de développement durable. La problématique donnée est la suivante : comment l'administration générale peut-elle contribuer à la réalisation du développement durable à la lumière du droit en Algérie ? Selon les méthodes d'étude les plus importantes consistant en la méthode descriptive, l'Algérie comme étude de cas et approche durable pour trouver de nouvelles alternatives de développement hors du secteur des hydrocarbures à la lumière de l'approche de l'administration rationnelle, puisque l'Algérie dispose d'une richesse lui permettant de diversifier son économie et de réaliser le développement durable avec ses différentes dimensions. Ainsi, l'étude a conclu au fait que le développement durable doit être réalisé à la lumière d'une administration générale rationnelle consacrant le principe de droit pour la mise en œuvre efficace des politiques de développement durable. En outre, l'existence d'une société consciente de sa responsabilité à travers la coopération entre tous les acteurs officiels et non-officiels pour atteindre la croissance durable, augmenter le niveau de l'économie nationale, la soutenir en encourageant l'investissement durable et faire avancer la roue du développement vers la réalisation de l'équilibre, de la justice, de la sécurité et de la durabilité
