أثر الانفتاح السياسي على التعددية النقابية في الجزائر 1989-2014

Abstract

تهدف هذه الدراسة للبحث عن أثر الانفتاح السياسي الذي شهدته الجزائر من الأحادية السياسية إلى التعددية السياسية على ممارسة العمل النقابي، ولمعرفة مدى أثر الانفراج الذي جاء به الانفتاح السياسي على حرية نشاط النقابات وهل انعكست التعددية السياسية على التعددية النقابية؟ وبذلك تبحث الدراسة في حقيقة ممارسة العمل النقابي في الجزائر الذي ظل منذ الاستقلال محتكراً للدولة. ورغم القوانين التي فسحت المجال للتعددية النقابية منذ نهاية القرن الماضي إلا أن أساليب المراوغة من قبل السلطة وتَمَنُّعها عن التفاوض مع النقابات المستقلة إلا في مسائل محدودة، شكك في كون هذه الأخيرة تعتبر بالفعل شريك اجتماعي، وإنعكس على فاعلية الممارسة النقابية طيلة العقود الماضية. وبذلك خلصت الدراسة بأن النقابة في ظل الأحادية السياسية كانت محتكرة تماما لدى الدولة، ورغم إقرار التعددية وفتح المجال لحرية ممارسة العمل النقابي في البلاد غير أن السلطة في الواقع سعت للتضييق واحتواء النشاط النقابي، وبالتالي ظلت التعددية النقابية شكلية. The aim of this research is to show the impact of the political transitionthat Algeria witnessed , from political unilateralism to political multilateralism, on the syndical movements. The paper also focuses on the extent of the impact of the political openness on the freedom of syndical activity. Has political multilateralism come up with any reforms ? The study attempts to clarify the reality of the practice of syndication in Algeria, which since the Independence has been monopolized by the state. Despite the laws that have been given to the syndical pluralism since the end of the last century, the elusion tactics from the authority and its abstention from negotiation with the independent syndicates made one doubt if the latter is really considered as a social partner. This situation called into doubtas well the effectiveness of the syndication over the past decades The study found that the syndical work ,during the existence of political unilateralism, was totally overwhelmed by the state, and inspite of the recognition of multilateralism and the permission to practice syndicalism more freely in Algeria, the government in fact made it difficult for these syndical groups. Consequently, the suydical multilateralism remained, in nominal. Résumé: Cette étude a pour objet de déterminer l’impact de l’ouverture politique que l’Algérie a pu réaliser, de l’unilatéralisme politique au pluralisme politique sur l’exercice du travail syndical, de déterminer dans quelle mesure la détente politique a-t-elle affecté la liberté d’action syndicale et si le pluralisme politique a-t-il été reflété dans le pluralisme syndical? L'étude examine donc la réalité de la pratique du travail syndical en Algérie, qui est depuis l'indépendance un monopole d'État. Malgré les lois qui ont ouvert la voie au pluralisme syndical depuis la fin du siècle dernier, les manœuvres évasives du pouvoir et son refus de négocier avec les syndicats indépendants, sauf sur des questions limitées, ont remis en question le fait que ces derniers soient effectivement des partenaires sociaux et ont reflété l'efficacité de la pratique syndicale des dernières décennies. L'étude conclut que, dans le cadre de l'unilatéralisme politique, le syndicat était entièrement monopolisé par l'État, et que, malgré la reconnaissance du pluralisme et l'ouverture de la liberté d'action syndicale dans le pays, le pouvoir s'est en fait efforcé de restreindre et de contenir l'activité syndicale, le pluralisme syndical est resté une formalité.
