Abstract

تعتبر المسؤولية المدنية للمؤسسات االستشفائية الخاصة مسؤولية عقدية تقوم على أساس االخالل بااللتزامات التي يرتبها عقد االستشفاء، كما تقوم عن عدم تقديم الخدمات العادية للمريض أثناء إقامته فيها للعالج، كما تكون كذلك مسؤولة عن أخطاء تابعيها من أطباء ومساعدين، فمتى توافرت أركانها تكون المؤسسة االستشفائية ملزمة بتعويض المريض لجبر الضرر الالحق به .La responsabilité civile des établissements hospitaliers privés est d’ordre contractuelle et est fondé sur le manquement aux obligations stipulées, elle résulte également de l’absence de toute prestation ordinaire destinée au malade lors de son séjour pour les soins. Elle peut être attribuée aussi à des faute médicales et paramédicales, ainsi, tant que ses fondements sont réunis, l’établissementhospitaliers se trouve obliger de dédommager le malade pour le préjudice subi.The civil liability of private hospital establishments is a contractual responsibility based on the breach of the obligations stipulated by the hospital contract, not only to provide regular services to the patient during the treatment, but also it is responsible for the errors of its followers of doctors and assistants. When there are elements are united ,The hospital institution is obliged to compensate the patient for reparation.
