فعالية القضاء الجنائي الدولي في تجسيد العدالة الجنائية

Abstract

القضاء الجنائي الدولي يمثل نظاما قضائيا عالميا يتعامل مع الجرائم الأشد خطورة التي تمس المجتمع الدولي بأسره، بحيث يتمثل دور هذا النظام في التحقيق والملاحقة القضائية للأفراد المتهمين بارتكابها، بغض النظر عن مناصبهم أو جنسياتهم ودون استثناء، هذا القضاء شهد أجيالا ولكل منه لمسته الخاصة في وضع أحكام واجتهادات قضائية كان لها الأثر البارز في تحرير ميثاق روما الأساسي. وفي ظل عالم متغير ومعقد، تظل المحكمة الجنائية الدولية مؤسسة حيوية في السعي لتحقيق العدالة الدولية، فبعد مرور عقدين من عمل المحكمة، بات تحقيق العدالة مرهون بمجهودات وجرأة قضاتها الى جانب مسعى الدول في دعمها لها، فمثلما كان لهاته الأخيرة الإرادة في انشاء قضاءات جنائية دولية، فإن تجسيد العدالة لا يزال في حاجة لإرادتها في تعزيز دور هاته المحكمة ودعم مواقفها، كونها جزءا من الالتزام العالمي، الذي يستدعي بناء نظام دولي قائم على سيادة القانون واحترام حقوق الإنسان، على النحو المرجو لمنع الإفلات من العقاب وإرساء العدالة الجنائية الدولية. International criminal judiciary represents a global judicial system that deals with the most serious crimes affecting the entire international community. The role of this system is to investigate and prosecute individuals accused of committing these crimes, regardless of their positions or nationalities, without exception. This judiciary has experienced many generations, each with its own unique contributions in establishing rulings and judicial interpretations that have significantly influenced the drafting of the Rome Statute. In a changing and complex world, the International Criminal Court (ICC) remains a vital institution in the pursuit of international justice. After two decades of the court’s operation, achieving justice now hinges on the efforts and boldness of its judges, alongside the commitment of states to support it. Just as states had the will to establish international criminal judiciaries, the realization of justice continues to depend on their desire to strengthen the role of the ICC and stand by it in its decisions. This support is part of a global commitment to building an international system based on the rule of law and respect for human rights, as envisioned in the prevention of impunity and the establishment of international criminal justice. La juridiction pénale internationale représente un système judiciaire mondial qui traite des crimes les plus graves affectant l'ensemble de la communauté internationale. Le rôle de ce système est d'enquêter et de poursuivre les individus accusés de commettre ces crimes, quel que soit leur poste ou leur nationalité, sans exception. Ce système judiciaire a connu des générations, chacune apportant sa contribution unique dans l'établissement de décisions et d'interprétations judiciaires ayant significativement influencé la rédaction du Statut de Rome. Dans un monde en constante évolution et complexe, la Cour pénale internationale (CPI) reste une institution vitale dans la quête de la justice internationale. Après deux décennies de fonctionnement de la cour, la réalisation de la justice dépend désormais des efforts et du courage de ses juges, ainsi que de l'engagement des États à la soutenir. Tout comme les États ont eu la volonté de créer des juridictions pénales internationales, la réalisation de la justice continue de dépendre de leur désir de renforcer le rôle de la CPI et de la soutenir dans ses décisions. Ce soutien fait partie d'un engagement mondial à construire un système international basé sur l'État de droit et le respect des droits de l'homme, tel que souhaité dans la prévention de l'impunité et l'établissement de la justice pénale internationale.
