الحماية الدولية للحقوق والحريات الأساسية في ظل الظروف الإستثنائية

Abstract

يعتبر موضوع حقوق الإنسان من المواضيع التي تسترعي الاهتمام الواسع من مختلف الهيئات الوطنية والدولية، وبالرغم من هذه الأهمية نجد العديد من الدول التي تلجأ إلى تضييق وتقييد هذه الممارسة خاصة في الظروف الاستثنائية، وذلك حتى في وجود ترسانة قانونية دولية تحتم على الدول احت ا رمها وضمان ممارسة فعلية لها. هذه الد ا رسة تسلط الضوء على الحماية التي تقرها مختلف المواثيق والهيئات الدولية ومسؤولية الدولة في حماية رعاياها من كل الانتهاكات الجسيمة التي تطالها.The topic of Human Rights attracts broad interest of various national and international instruments regardless of this importance, many countries resort to constrict and straiten their practice, specifically in exceptional circumstances, even with the existence of an international legal arsenal that requires a corresponding obligation on States to respect and ensuring the effective exercise of them. This study shed light on the protection that is recognized by several international charters and organizations, and State's responsibility to protect its subjects from all the serious violations that affect them.Les droits de l'homme attirent un intérêt considérable de divers instruments nationaux et internationaux. Indépendamment de cette importance, de nombreux pays ont recours à la restriction et limitation de leur pratique, en particulier dans des circonstances exceptionnelles, même avec l'existence d'un arsenal juridique international qui impose aux États l'obligation de les respecter et d'en assurer l'exercice effectif. Cette étude met en lumière la protection reconnue par plusieurs chartes et instruments internationaux, ainsi que la responsabilité de l'État de protéger ses sujets de toutes les violations graves qui les affectent.
