Abstract

حماية الحق في التعليم في ضوء القانون الدولي لحقوق الإنسان يتبوأ الحق في التعليم مكانة مرموقة في المنظومة الدولية لحقوق الإنسان التي كفلت لجميع البشر التمتع به بصرف النظر عن السن أو الجنس أو اللغة أو غيرها، لكونه يعد حقا تمكينيا لاغني عنه لإعمال كافةالحقوق و الحريات .اعترف المجتمع الدولي ، وخاصة بعد صدور الإعلان العالمي لحقوق الإنسان لعام 1948 بعالمية الحق في التعليم و ترابطه مع الحقوق الأخرى، و بعد ذلك ، أنشأت المواثيق الحقوقية الآليات لتعزيزه و حمايته ، و مراعاة معايير جودته.وسارت المنظمات الإقليمية في كل من أوروبا، أمريكا، إفريقيا و المنطقة العربية نفس النهج ، و استندت إلى مجموعة واسعة من المواثيق الإقليمية لحقوق الإنسان التي أرست الأطر القانونية لرصد و مراقبة تنفيذ الدول لالتزاماتها بشان الحق في التعليم La Protection du Droit à l'Education à la Lumière du Droit International des Droits de l'Homme Le droit à l'éducation occupe une place importante dans le système international des droits de l'homme, qui a garanti sa jouissance à tous les êtres humains sans distinction d'âge, de sexe, de langue ou autre, car il est considéré comme un droit indispensable à la réalisation de tous les droits et libertés. La communauté internationale, en particulier après l’émergence de la Déclaration universelle des droits de l'homme en 1948, a reconnu l'universalité du droit à l'éducation et son interrelation avec d'autres droits. Par la suite, les conventions des droits de l'homme ont developpé des mécanismes pour sa promotion et sa protection , ainsi que le respect de ses normes de qualité. Les organisations régionales ont adopté en Europe, Amérique, Afrique et dans la région arabe la même approche, en se basant sur un large éventail de conventions régionales des droits de l'homme qui ont établi des cadres juridiques pour contrôler la mise en œuvre de leurs obligations en matière de droit à l'éducation . The Protection of the Right to Education in the Light of International Human Rights Law The right to education occupies a prominent position in the international human rights system, which has guaranteed its enjoyment for all human beings regardless of age, gender, language or other, as it is considered indispensable for the realization of all rights and freedoms. The international community, especially after the issuance of the Universal Declaration of Human Rights in 1948, recognized the universality of the right to education and its interrelations with other rights. Subsequently, human rights conventions developed mechanisms for its promotion and protection, and observance of its quality standards. Regional organizations have adopted the same approach in Europe, America, Africa and the Arab region, based on a wide range of regional human rights conventions that have established legal frameworks to monitor States’ obligations in matter of the right to education. key words:
