'' الحماية القانونية من الأضرار الناجمة عن استهلاك الأدوية ''

الملخص: تعد الأدوية الركيزة الأساسية في حياة الانسان لأنها تساهم في شفائه من مختلف الأمراض التي تصيبه أو على الأقل تقلل من آلامه وتحسن من بنيته الجسمية، ولهذا ضعت مختلف التشريعات الوطنية والأجنبية ضوابط التعامل بها من حيث انتاجها وتوزيعها إلى غاية بيعها للمستهلك، وعلى هذا النحو تم فرض الحماية القانونية من مختلف الأضرار التي تنتج عن الأدوية وتمس صحة المستهلك عن طريق إقامة المسؤولية المدنية على كل من منتج وبائع الدواء، إذا ما تجاوز الالتزامات المفروضة عليه وأدى ذلك إلى إصابة متناوله أو مستخدمه بأضرار حيث لا يتمكن من الحصول على التعويض إلا بإثبات الخطأ، ونظرا لعجز قواعد المسؤولية المدنية التقليدية في حماية المتضررين من الأدوية تم تبني المسؤولية الموضوعية كنظام قانوني جديد من طرف المشرع الفرنسي والجزائري تقوم على أساس وقوع الضرر وعليه ضمان حصول المضرور على التعويض، إلى جانب ذلك تقوم مسؤولية الصيدلي الجزائية عن الجرائم غير العمدية ويسأل كذلك عن الجرائم العمدية التي يرتكبها أثناء مزاولته لمهنته وعن تلك المنصوص عليها في قانون العقوبات وأيضا الواردة في القوانين الخاصة.
