الحـــمـــايـة الـــقـــانـــونـــيــة للـــطـــفـــل المـــعـــرض لخـــطـــر مـــعـنـــوي

Abstract

ان طفل اليوم هو رجل الغد و هو مستقبل الشعوب، و لكونه ذلك الكائن المستضعف ناقص النمو، فقد عمدت كل التشريعات سواء الدولية و أهمها اتفاقية حقوق الطفل لسنة 1989 أو الوطنية الى حمايته من الخطر المعنوي، و في هذا الاطار تكللت مساعي المشرع الجزائري بوضع قانون حماية الطفل لسنة 2015، و هو ما يعتبر خطوة هامة في مجال حماية الطفل حيث كرس له حماية فعلية خصوصا باستحداثه الهيئة الوطنية لحماية و ترقية الطفولة تهتم بتلقي الاخطارات عن حالات الطفل المعرض لخطر معنوي و متابعتها، و عليه يعتبر قانون حماية الطفل خطوة هامة في مجال تشريع حماية الطفل في الجزائر تماشيا مع المواثيق الدولية و التشريع المقارن في الدول العربية L'enfant d'aujourd'hui est l'homme de demain et l'avenir des peuples. En raison de sa vulnérabilité, toutes les législations qu'elles soient internationales, dont la plus importante est la Convention relative aux droits de l'enfant de 1989 ou nationales ont cherché à le protéger du danger moral. Dans ce contexte, les efforts du législateur algérien ont abouti en 2015 à l’élaboration d'une loi sur la protection de l'enfant qui est considérée comme une étape importante dans le domaine de la protection de l'enfance notamment par la création de l’organe national de la protection et de la promotion de l'enfance, chargé de recevoir et de suivre les dénonciations relatives aux enfants exposés à un danger moral. La loi sur la protection de l'enfance, en conformité avec les conventions internationales et la législation comparée de pays arabes, constitue une étape importante en matière de législation sur la protection de l'enfance en Algérie. Todays’s children is tomorow’s man, the futur of nations, so because the child is the most vulnerable and under-devloped, he must benefit from legal protection of international legilation such as the convention on the right of the child, and the national legislation from moral danger. In this context, the algerien legislator has drafted the protection of children law in 2015, who dedicated effectivechild protection, especially with establishment of the national authority of the protection and promotion of children, protection act of child is thus an important step in the area of child protection.
