تنفيذ عقد النقل البري للبضائع عبر الطرقات

Abstract

Le transport de marchandises par route est l'un des moyens de transport les plus importants connus par l’activité économique et commerciale au niveau international et national, et le transport routier a une relation étroite avec le transport maritime. Et cela, en accomplissant la tâche de transporter le conteneur ou la marchandise en vrac par route pour le livrer à la destination finale. La relation contractuelle est établie dans le but d’exécuter le contrat entre l'expéditeur et le transporteur, et le rôle du destinataire est de recevoir la marchandise. Cette relation peut également être établie entre les trois parties, l’expéditeur, le transporteur et le destinataire par le transport du conteneur ou de la marchandise en vrac du port à la destination finale convenue avec le transporteur terrestre, de sorte que le propriétaire de la marchandise (conteneur, marchandise en vrac) doit l’assurer pendant son transport du port à la destination finale. En outre, cette relation contractuelle engendre des obligations et des responsabilités durant l'exécution du contrat conformément à l'accord conclu entre les parties contractantes. The transport of goods by road is one of the most important means of transport known for economic and commercial activity at international and national level, and road transport has a close relationship with maritime transport by accomplishing the task of transporting the container or the bulk goods by road to deliver it to the final destination. The contractual relationship is established for the purpose of executing the contract between the shipper and the carrier, and the role of the consignee is to receive the goods. This relationship may also be established between the three parties, the shipper, the carrier and the consignee by transporting the container or bulk goods from the port to the final destination agreed with the ground carrier, so that the owner of the goods (container, bulk goods) must insure it during its transportation from the port to the final destination. Furthermore, this contractual relationship creates obligations and responsibilities during the performance of the contract in accordance with the agreement between the contracting parties. يعتبر نقل البضائع عبر الطرقات أحد أهم وسائل النقل التي يعرفها النشاطين الاقتصادي والتجاري دوليا ووطنيا كما أن النقل عبر الطرقات له علاقته وطيدة بالنقل البحري وذلك بإنهاء مهمة نقل الحاوية أو البضاعة السائبة من الميناء الى الوجهة النهائية المتفق عليها مع الناقل البري حيث انه على صاحب البضاعة (الحاوية ، البضاعة السائبة) تأمينها أثناء من الميناء الى الواجهة النهائية . تنشأ العلاقة التعاقدية لتنفيذ العقد بين المرسل اليه في تسلم البضاعة، كما يمكن أن تكون بين الأطراف الثلاثة المرسل والناقل والمرسل اليه وذلك من خلال نقل الحاوية او البضاعة السائبة من الميناء الى الوجهة النهائية .كما ينشأ عن هذه العلاقة التعاقدية التزامات ومسؤوليات أثناء تنفيذ العقد وفقا للاتفاق المبرم بين الأطراف المتعاقدة
