Abstract

تعد الجريمة المعولمة من أهم العوامل التي ساهمت في بروز العديد من الظواهر الإجرامية خاصة الجرائم المستحدثة منها جريمة تهريب الآثار والتي ساعدت على إنتشارها عبر القارات عوامل أخرى تتجلى أبرز مظاهرها في ثورة المعلومات والإتصالات والتكنولوجيات، ما نتج عنها من خصوصية لهذه الجريمة وتطورها الى نسق أفضى الى جعل غالبية أنشطتها الإجرامية تتم في إطار الجرائم المنظمة وعليه تهدف الدراسة الى بيان خصائصها، أركانها وأشكالها التي تميزها عن غيرها من النظم الإجرامية الأخرى. امام هذه الخطورة الاجرامية التي تشكل تحديا بارزا للأمن واستقرار الدول بفعل ما تنطوي عليه من تهديد صارخ للتراث وتشويه للهوية الإنسانية بإتخاذها أبعادا خاصة تتمثل أهمها في انقطاع الشعوب عن ماضيها التاريخي الحضاري وتحقيق الغزو الفكري والثقافي، لذلك كان لزاما على الدول مواجهتها من خلال تعزيز آليات التعاون الدولي وتكثيف الجهود الدبلوماسية والعمل على استصدار القرارات الدولية بشأن التصدي لها والبحث عن السياسات الجزائية والعقابية الكفيلة بتحقيق الفعالية المرجوة في مجال الوقاية منها ومكافحتها. Face à cette menace pénale, qui pose un défi important à la sécurité et à la stabilité des États en raison de la menace flagrante qui pèse sur le patrimoine et de la distorsion de l’identité humaine en prenant des dimensions particulières, dont la plus importante est l’interruption des peuples de leur passé culturel historique et la réalisation d’une invasion intellectuelle et culturelle, les États ont donc dû y faire face en renforçant les mécanismes de coopération internationale, en intensifiant les efforts diplomatiques et en s’efforce d’obtenir des résolutions internationales sur leur traitement et en cherchant des sanctions et des politiques visant à atteindre l’efficacité souhaitée pour les prévenir. In the face of this criminal threat, which poses a significant challenge to the security and stability of States because of the blatant threat to heritage and the distortion of human identity by taking special dimensions, the most important of which is the interruption of peoples from their historical cultural past and the achievement of intellectual and cultural invasion, therefore, states had to face them by strengthening the mechanisms of international cooperation, intensifying diplomatic efforts and working to obtain international resolutions on addressing them and seeking criminal and punitive policies to achieve the desired effectiveness in preventing them.
