Abstract

Les actes détachables dans l'expropriation pour cause d'utilité publique Résumé Cette étude vise à clarifier les limites et les effets de l'application de la théorie des actes détachables dans l’expropriation pour cause d’utilité public. Pour y parvenir, le premier chapitre de l'étude examine la détermination des actes détachables aux différentes étapes de l'expropriation, tandis que le deuxième chapitre examine les effets de ce séparatisme sur chaque décision et pour l'ensemble du processus. L’étude a abouti à des résultats juridiques, dont le plus important est le risque d’annulation de la décision distincte, ce qui peut équivaloir à la démolition du processus d’expropriation, quelle que soit l’étendue des progrès de l’administration dans sa mise en œuvre. Il est également apparu clairement que l'application de cette théorie contribue à rendre justice car elle constitue une garantie importante pour l'exproprié et la suprématie du principe de légalité. Detachable administrative decisions in expropriation for public utility Abstract This study aims to clarify the limits and effects of applying the theory of the detachable administrative decisions in expropriation for public utility. To achieve this, the first chapter of the study examines the determination of detachable administrative decisions in the different stages of expropriation, while the second chapter examines the effects of that separatism on every decision and for the entire process. The study reached legal results, the most important of which is the danger of canceling the detachable administrative decision, which may amount to the demolition of the expropriation process, regardless of the extent of the administration’s progress in implementing it. It also became clear that the application of this theory contributes to achieving justice as it constitutes an important guarantee for expropriated and the supremacy of the principle of legality. Key words: expropriation; detachable administrative decisions, complex operations. القرارات القابلة للانفصال في نزع الملكية للمنفعة العمومية الملخص تهدف هذه الدراسة إلى بيان حدود وآثار تطبيق نظرية القرارات القابلة للانفصال في نزع الملكة من أجل المنفعة العمومية؛ ولتحقيق ذلك، يدرس الباب الأول منها صور القرارات القابلة للانفصال في المراحل المختلفة من نزع الملكية، بينما يبحث الباب الثاني في آثار تلك الانفصالية على كل قرار وعلى العملية برمتها. وتوصلت الدراسة إلى نتائج قانونية أهمها خطورة إلغاء القرار المنفصل التي قد تصل إلى حد هدم عملية نزع الملكية، مهما بلغت درجة تقدم الإدارة في تنفيذها، كما اتضح أن تطبيق هذه النظرية يساهم في تحقيق العدالة باعتباره يشكل ضمانة هامة للمنزوعة منهم ملكيتهم ولسمو مبدأ المشروعية. الكلمات المفتاحية: نزع الملكية- القرارات القابلة للانفصال- العمليات المركبة
