Abstract

" حقوق الضحايا أمام المحكمة الجنائية الدولية " نظرا لتزايد الجرائم الدولية ومواجهة خطورتها المدمرة التي لاحقت الإنسان في وجوده تـمّ إنشاء محكمة جنائية دولية دائمة، و التي اعتبرت بمثابة خطوة نحو تحقيق العدالة الجنائية الدولية وأيضا بتحقيق فكرة الجزاء الجنائي وملاحقة المتهمين عن طريق إعمال مبدأ عدم الإفلات من العقاب، مما زاد للضحية أكبر ضمان وحماية والاعتراف لهم بحقوق يتمتعون بها بموجب النظام الأساسي لروما والقواعد الإجرائية وقواعد الإثبات، حيث يستفيد الضحايا بجبر الأضرار عن الانتهاكات الخطيرة التي مستهم ومشاركتهم في الإجراءات القضائية، وتمثيلهم بواسطة خبراء قانونيين للدفاع عن مصالحهم طوال سير إجراءات المحاكمة، كما تلعب المحكمة دورا هاما في اتخاذ تدابير لحماية الضحايا خلال فترة المحاكمة، فكان الاهتمام بهذه الفئة عن طريق إنشاء قسم يتعلق بالضحايا والشهود الذي مكّن الضحايا من تخطي الأزمات النفسية والصدمات .
