البعد البيئي في مجال الصفقات العمومية

Abstract

أصبح الحديث في اآلونة األخيرة عمى ادراج البعد البيئي في الصفقات العمومية من أجل الحرص عمى تنفيذ صفقة عمومية صديقة لمبيئة، وهذا عن طريق ادراج ابعاد بيئية في دفتر شروط الصفقة العمومية وهذا استجابة لتمبية حاجيات الصفقة الخضراء، ولهذا يجب مراعاة االليات التقنية والقانونية في عروض المر شحين التي تحرص المصمحة المتعاقدة عمى الجانب البيئي فيها وفي حالة عدم مراعاة هذا الجانب من قبل المترشحين تكون عروضهم معرضة لإلقصاء من الصفقة العمومية قبل قبولها وفي حالة تم قبولها وتم اكتشاف مخالفات بيئية تتعرض اصحابها الى جزاءات ادارية تفرضها المصمحة المتعاقدة، وقد تصل حتى الى جزاءات قضائية.Récemment, il a été question d'inclure la dimension environnementale dans les marches publiques afin de garantir la mise en œuvre d'un accord public respectueux de l'environnement, en incluant les dimensions environnementales dans le cahier des charges de marche public, afin de répondre aux besoins de l'accord vert. Le pouvoir adjudicateur est soucieux de l'aspect environnemental, faute de quoi ses offres sont soit directement exclues du marché, soit sanctionnées par des sanctions administratives imposées par le pouvoir adjudicateur et peuvent même entraîner des sanctions judiciaires.Abstract : Recently, it has been a question of including the environmental dimension in public markets in order to guarantee the implementation of an environmentally friendly public agreement, including the environmental dimensions in the public contract specifications, in order to meet the needs of the Green Agreement. The contracting authority is concerned about the environmental aspect, otherwise its offers are either directly excluded from the market or sanctioned by administrative sanctions imposed by the contracting authority and may even lead to legal sanctions.
