السياسة الجنائية في مكافحة العنف ضد الطفل في التشريع الجزائري

Abstract

تتناول هذه الأطروحة دراسة السياسة الجنائية في مكافحة العنف ضد الطفل في التشريع الجزائري من خلال تحليل الإطار المفاهيمي للسياسة الجنائية وأبعادها التشريعية والعملية، باعتبارها أداة قانونية لحماية الطفل بوصفه فئة خاصة تستوجب حماية معززة. وتركز الدراسة على سياسة التجريم والسياسة العقابية والتدابير الوقائية التي اعتمدها المشرع الجزائري لمواجهة مختلف صور العنف ضد الطفل، وذلك عبر تحليل النصوص القانونية الواردة في قانون العقوبات وقانون الاجراءات الجزائية وقانون حماية الطفل، وتقييم مدى كفايتها في تحقيق الردع وحماية المصلحة الفضلى للطفل. وتخلص الأطروحة إلى أن مكافحة العنف ضد الطفل تقتضي اعتماد سياسة جنائية شاملة لا تقتصر على الزجر العقابي، بل تقوم أيضا على الوقاية والتدخل المبكر وتكامل الأدوار بين الآليات القضائية والاجتماعية، بما يضمن حماية جنائية فعالة ومستدامة للطفل في إطار التشريع الجزائري This thesis examines criminal policy in combating violence against children within the Algerian legal system, by analyzing its conceptual framework and its legislative and practical dimensions, as a legal mechanism aimed at protecting the child, as a particularly vulnerable category requiring enhanced legal protection. The study addresses the criminalization policy, penal policy, and preventive measures adopted by the Algerian legislator to confront the various forms of violence against children, through an analytical examination of the relevant provisions of the Penal Code and the Child Protection Law, and by assessing their effectiveness in achieving deterrence and ensuring the best interests of the child. The thesis concludes that effective protection against violence towards children requires the adoption of a comprehensive criminal policy, that goes beyond punitive sanctions to include preventive approaches, early intervention, and institutional coordination between judicial and social bodies, thereby ensuring effective and sustainable criminal protection for children within the Algerian legal framework
