LA CRIMINALITE EN ALGERIE ET SES MUTATIONS ENTRE TEXTES ET PRATIQUE JUDICIARE

Abstract

Si la société humaine est caractérisée par son évolution, ce terme qui renvoi à la notion de changement, changement dans le mode vie, comme le passage de la vie rurale à celle citadine, de l’état de nomadisme au sédentarisme ; le crime dans son sens large comme acteinhérent à toute société, n’est pas resté en marge de ces changements. Influencé par l’organisation humaine que ce soit sur le plan économique ou politique, les infracteurs trouvent toujours moyen de tirer profit des situationsinduites par le changement du mode gouvernance ou les situations économiques qu’elles soient fastes ou néfastes au groupe, et en dernier lieu les avancées technologiques qui profitent bien aux crimes. L’Algériedans cette optique, de son indépendance à l’heure actuelle, a subi d’importantes mutations, la criminalité aussi, de sorte que le législateur dans la nécessité de faire face aux nouvelles formes de criminalité, a promulgué tant de textes répressifs, l’interaction entre ces textes et le phénomène criminel, n’a pas toujours abouti aux résultats escomptés, une situation qui devrai interpeler les concernés par la lutte contre le phénomène criminel à revoir les politiques de lutte contre la criminalité , à commencer par le fer de lance de cette lutte la justice pénale, et les sciences qui y contribuent dans cette lutte réunies sous la coupe de la criminologie.

Crime in Algeria and its changes Between statutes and judicial practice Abstract: If human society is characterized by its evolution, this term, which refers to the notion of change, change in the way of life, such as the transition from rural life to urban life, from nomadic to sedentary; crime in its broad sense as an act inherent to any society has not remained on the margins of these changes. Influenced by human organization whether on the economic or political level, offenders always find ways to take advantage of situations induced by changes in the mode of governance or economic situations whether they are favorable or harmful to the group, and lastly technological advances which benefit crimes. Algeria, in this perspective, from its independence to the present time, has undergone significant changes, crime too, so that the legislator in the need to face the new forms of crime, has promulgated so many repressive texts, the interaction between these texts and the criminal phenomenon, has not always led to the expected results, a situation which should challenge those concerned by the fight against the criminal phenomenon to review the policies of fight against crime, starting with the spearhead of this fight criminal justice, and the sciences which contribute to this fight united under the umbrella of criminology. : الملخص إذا كان المجتمع البشري يتميز بالتطور، فإن هذا المصطلح الذي يشير إلى مفهوم التغيير، أي تغيير نمط الحياة، كالانتقال من الحياة الريفية إلى الحياة الحضرية، ومن البداوة إلى الاستقرار؛ يخص أيضا الجريمة، بمعناها الواسع كفعل متأصل في أي مجتمع، إذ تتأثر هي كذلك نتيجة هذه التغيرات. وبتأثير التنظيم البشري، سواءً على المستوى الاقتصادي أو السياسي، إذ يجد المجرمون دائمًا سبلًا لاستغلال الأوضاع الناجمة عن تغيرات أسلوب الحكم أو الأوضاع الاقتصادية، سواءً أكانت مواتية أم ضارة للجماعة، وقد استفاد الاجرام من التقدم التكنولوجي مثلا في الوقت الحالي. لقد شهدت الجزائر من هذا المنظور، منذ استقلالها إلى يومنا هذا، تحولات كبيرة، حتى في مجال الجريمة، بحيث أن المشرع مواجهة للأشكال الجديدة للجريمة، أصدر العديد من النصوص القمعية، ولم يكن التفاعل بين هذه النصوص والظاهرة الإجرامية دائما يؤدي إلى النتائج المرجوة، وهو وضع ينبغي أن يفرض على المعنيين بمكافحة الظاهرة الإجرامية مراجعة السياسة المنتهجة في مكافحة الجريمة، بدءا من رأس حربة هذه المكافحة العدالة الجنائية، و التي عليها ان تستعين لأكثر فعالية بالعلوم التي تساهم في هذه المعركة تحت مظلة علم الإجرام. كلمات مفتاحية: الجريمة- علم الاجرام- السياسة الجنائية-العدالة الجنائية-الجنوح
