The principle of non-intervention serves as a fundamental pillar of international law, intrinsically linked to and reinforcing the concept of state sovereignty. It acts as a vital legal shield designed to protect the reserved domestic jurisdiction of states from coercive external interference in their political, economic, and military affairs. This right is universally guaranteed, yet its application exists in a complex tension with the international community's competing obligations to safeguard human rights and ensure global peace and security. Intervention is broadly defined as an act by a state or international organization intended to coerce another state into a specific course of action regarding its internal or external affairs. Intervening actors frequently justify such measures under legal pretexts such as self-defense. The most prevalent forms of this illicit practice include political intervention, which targets the core integrity of the state; economic intervention, which destabilizes national security and often precedes military action; and military intervention, whether direct or through proxy forces, which yields devastating humanitarian consequences. While intervention is deemed an internationally wrongful act irrespective of its motives, certain exceptions confer legitimacy upon it. These exceptions include intervention undertaken upon the genuine invitation of a legitimate governmental authority, often based on a mutual defense treaty. Furthermore, a third state may legitimately intervene to counter another's unlawful interference, a concept known as intervention against intervention. The most prominent and contentious exception is humanitarian intervention to protect fundamental human rights from egregious violations. Ultimately, the exercise of any right to intervene is bound by the concomitant obligation to not infringe upon the lawful rights and interests of other states, reflecting the perpetual search for balance within the international legal order Le principe de non-intervention se présente comme le corollaire du principe de souveraineté. | en_US |
