Indeed, the principle of the autonomy of arbitration has prevailed and succeeded in overcoming the obstacles arising from the general rule prohibiting public legal entities from entering into arbitration agreements, as provided for in domestic laws. However, the legal framework governing arbitration in PPP matters has not yet been defined by a specific regime. It therefore remains subject to the general law of arbitration. This has not prevented us from highlighting the distinctive features of arbitration in the context of public-private partnerships. In fact, the assignment of judicial review powers to the administrative judge has marked the beginning of a new legal framework for arbitration in PPPs, one that aspires to greater autonomy.
