Résumé : Le monde a été balayé par une vague de développements scientifiques et technologiques qui ont contribué à ouvrir la voie à l’utilisation de nombreux moyens et techniques visant à surmonter les obstacles au développement à tous les niveaux, de manière à garantir rapidité et efficacité. cela a touché, en premier lieu, l'environnement, qui est considéré comme le premier contact avec ces moyens car il était initialement dirigé vers lui comme la première ressource du développement, et lorsque la communauté internationale a constaté la détérioration de la condition de ce dernier et son impact sur la santé, il a tiré la sonnette d'alarme et a entrepris d'établir des mécanismes juridiques qui limitent le degré de danger résultant de l'utilisation de la science et de la technologie, parmi lesquels le principe de précaution, qui a été considéré comme une avancée dans le domaine de la protection de l'environnement, et conformément à la relation entre l'environnement et la santé, selon qu'elle en est affectée négativement ou positivement, et à la lumière de l'aggravation de phénomènes sanitaires graves qui affectent la vie de l'individu et sa sécurité physique et morale, l'extension de l'application du principe de la précaution comme moyen de le protéger nécessite une activation. « The precautionary principle as a mechanism for protecting health » Abstract : The world has been swept by a wave of scientific and technological developments that have contributed to opening the way for the use of many means and techniques that aim to overcome obstacles in achieving development at all levels in a way that ensures speed and effectiveness. When the international community witnessed the deterioration of the latter’s condition and its impact on health, it sounded the alarm and moved to establish legal mechanisms that limit the degree of danger resulting from the use of science and technology. The precautionary principle was among them, which was considered a breakthrough in the field of environmental protection, and in accordance with the relationship that links the environment to health, as it is affected by it negatively or positively, and in light of the exacerbation of dangerous health phenomena that affect the life of the individual and his physical and moral safety, the extension of the application of the precautionary principle as a means of protecting it requires activation.

لقد إجتاح العالم موجة من التطورات العلمية والتكنولوجية التي ساهمت في فتح المجال لإستخدام العديد من الوسائل والتقنيات التي تهدف إلى تذليل العقبات في تحقيق التنمية على كافة الأصعدة بشكل يضمن السرعة والفعالية، غير أن هذا أثر أولا على البيئة التي تعتبر المحتك الأول بهذه الوسائل كونها في الأصل موجهة لها باعتبارها المورد الأساسي في التنمية، ولما عاين المجتمع الدولي تدهور حالة هذه الأخيرة وإنعكاسها على الصحة دق ناقوس الخطر وتحرك من أجل وضع الآليات القانونية التي تحد من درجة الخطورة الناجمة عن استعمال العلوم والتكنولوجيا وكان مبدأ الحيطة من بينها، الذي اعتبر بمثابة طفرة في مجال حماية البيئة، وعملا بالعلاقة التي تربط البيئة بالصحة حيث أنها تتأثر بها سلبا أو إيجابا وفي ظل تفاقم الظواهر الصحية الخطيرة التي تمس حياة الفرد وسلامته الجسدية والمعنوية فإن امتداد تطبيق مبدأ الحيطة كوسيلة لحمايتها يتطلب التفعيل.
