The double taxation phenomenon is one of the most important problems that the international collection knows, and it hinders the evolution of the international economy due to the increase of the financial burdens that burden the taxpayers. The most appropriate solution to confront this problem is to conclude bilateral agreements between different countries, according to the model developed by the Organization for Economic Co-operation and Development as well as United Nations, which constitute the main reference adopted by countries during their negotiations. These tax agreements include provisions aimed mainly at preventing the phenomenon of double taxation by adjusting the most common terminology in the international tax field, and formulating the basic principles related to the rules for the distribution of tax jurisdiction among the contracting states according to specific criteria (residence criterion, source of income criterion, permanent establishment criterion and fixed base standard). Where the right to tax is granted exclusively to either the State of residence or the State of origin, or jointly between them, with the application of the discount or exemption techniques. These agreements also include a set of complementary guarantees that protect the rights of taxpayers from arbitrariness of the tax administration and allow them to object to its decisions by resorting to the amicable procedure (mutual agreement) as well as tax arbitration. On the other hand, it protects contracting States' interests such as preventing the misuse of the provisions of tax agreements and urging cooperation in collecting taxes and exchanging information among them. | en_US |
