Abstract The enforcement and practical implementation of criminal judicial decisions require continuous supervision by the competent authorities. Once a judgment has been rendered and has become final following the exhaustion of all ordinary and extraordinary remedies, the convicted person is transferred to a penal institution if he or she was previously at liberty. Where the convicted person is already detained, the judgment or judicial decision imposing a custodial sentence is formally put into effect. Depending on the nature of the offence committed, the circumstances surrounding its commission, and its legal classification, the sentence imposed may consist of the death penalty, life imprisonment, fixed-term criminal imprisonment, or correctional imprisonment. The Judge supervises the enforcement of such sentences for the Enforcement of Sentences. During the period of incarceration, the convicted person must be provided with adequate healthcare and social assistance. He or she must also be classified within the appropriate category according to the applicable classification system and be given access to education, vocational training, and various rehabilitative activities. These measures are intended to promote rehabilitation and social reintegration and to achieve positive outcomes following release from the penal institution. Where the convicted person satisfies the statutory conditions for conditional release and has not committed any act contrary to the internal regulations of the penal institution, conditional release may be granted. The convicted person is consequently released for the remaining term of the sentence, subject to compliance with the conditions imposed. The convicted person may also be permitted to serve the sentence outside the penal institution. In such a case, he or she may be required to report weekly and sign the designated register at the court within whose territorial jurisdiction his or her place of residence is located. Alternatively, the convicted person may be placed under electronic monitoring by means of an electronic bracelet that enables the competent authorities to determine his or her location. In the event of a breach of the obligations imposed, the convicted person shall be required to serve the remainder of the sentence within the penal institution. This consequence applies both to conditional release and to electronic monitoring. The enforcement of the sentence may also be postponed where the convicted person was at liberty at the time the final judgment was rendered. Such postponement may be granted in cases involving the convicted person’s serious illness, the death of a family member, or the serious illness of a family member. Financial penalties may likewise be imposed on convicted persons. These penalties may take the form of confiscation of property where the property was used in the commission of an offence or was acquired through unlawful means. They may also consist of fines imposed either as a supplementary penalty accompanying a principal sentence or as the sole penalty prescribed for an offence punishable exclusively by a fine. |
