Abstract This study addresses the theme of "Mechanisms for Protecting the Marine Environment under Algerian Legislation and International Treaties." It aims to evaluate the effectiveness of the legal and institutional frameworks adopted at both national and international levels to confront the growing environmental threats to the marine medium. The research is structured into two main parts covering the conceptual, preventive, and punitive aspects of this vital issue. The first part of the study focuses on defining the legal nature of the marine environment and the sources of pollution threatening it, whether from land-based sources, maritime navigation operations, or energy activities on the continental shelf. It also highlights preventive mechanisms as the first line of defense, analyzing the role of environmental administrative oversight, licensing systems, and Environmental Impact Assessments (EIA). Furthermore, it examines the technical inspection and monitoring measures imposed by international conventions and Algerian legislation (specifically Law 03-10 on environmental protection and the Coastal Protection Law) to ensure the prevention of environmental damage before it occurs. The second part shifts to the deterrent and remedial aspects by reviewing the legal mechanisms pertaining to the liability regime for marine environmental damage. It provides an analytical study of the role of international treaties, such as UNCLOS and MARPOL, in establishing rules for liability and compensation, with a specific focus on the role of the International Oil Pollution Compensation Funds (IOPC). Additionally, the study evaluates the pivotal role of the Algerian judiciary (both civil and criminal) in suppressing environmental violations and implementing the "Polluter Pays Principle." It also assesses the alignment of modern national laws with Algeria's international obligations, particularly in light of recent amendments to the Maritime Code. The study concludes that protecting the marine environment in Algeria relies on a significant legal arsenal; however, its effectiveness remains contingent upon overcoming legislative fragmentation and activating modern technical monitoring mechanisms. The thesis recommends strengthening international cooperation to address emerging risks and modernizing the deterrent system to match the scale of transboundary environmental disasters, ensuring the sustainability of marine resources as a cornerstone of national and economic security. |
